    Hi can anyone tell me how long a provider needs to retain participant data after they have left the service?

    I have checked the Privacy Act, The disability Act as well as speaking to our Auditor, the NDS and the NDIS and no one can tell me. I know it is 7 years for Employee and Business records however no info for participant records??

    Anyone??

    Hi Gavin,

    Yes, it is seven years, and for any child U18, it is seven years beyond their 18th birthday, regardless of the service end date

    Hi Gavin,

     

    From my knowledge, the answer is Yes. An organisation should keep records of participants even after they are no longer with your service.

     

    The record doesn't have to be a hard copy; scanned copies are as good as hard copies.

     

    For example, if you have an external Audit, they could ask. If unexpected things happen to a client and become reportable incident, and the NDISQ&S commission want more info, they could contact you for those record.

    My understanding is that for adults it is 7 years.
