    Hello NDP Community,

Just wondering if anyone else has received a similar message to the one below from their employer? Or if anyone can tell me if this is in fact an NDIS requirement. I can't find anything on the NDIS website about it.

NDIS has a mandate requiring all providers to maintain a record of their employees' secondary employment. As a result, it is now compulsory for all staff members to complete and sign a Secondary Employment Declaration form as part of our compliance with the NDIS requirement.

    Thanks in advance,

    Alisha

    Hi Alisha,

This is part of the NDIS Practice Standards and Quality Indicators, under Human Resource Management. If you download the Practice Standards or the NDS Pracitce Standards Interpretive Guide, you should be able to see it there.  https://www.ndiscommission.gov.au/sites/default/files/2022-02/ndis-practice-standards-and-quality-indicatorsfinal1.pdf
    Hopefully this helps.

    Hi all

The NDIS Practice Standards - Human Resources management -  states on page 11, 4th point down from top - 'details of their secondary employment (if any)'. It is important to ensure that workers do not have any conflicts of interest regarding employment..eg. risk of worker working nights and days at two different workplaces, so not getting enough rest, putting themselves and clients at risk.

    Kind Regards

This is a requirement under the HRM component of the core Module of the Practice Standards and Quality Indicators. I am concerned that providers do not really understand how important it is to be able to show evidence of compliance with these PSQIs - these standards are what auditors measure providers against to be able to recommend to the Commission if a provider should be registered or reregistered to deliver services under the NDIS.

No, it is not an NDIS requirement. However it is not uncommon for employers to request this. They may want to know if there are any conflicts of interest. Also, many support workers have more than one job. Turning up for a shift when you have already worked 8 hours somewhere else may put clients at risk, especially after a nightshift. If you are only doing an office job, and your other job is unrelated it shouldn't matter.  Edit - I stand corrected by the above comments :) 2nd Edit - I could not see anything relating to second jobs of employees in the linked quality standards. I assume it comes under managing risks and conflicts of interest.

    Hi David,

Don't want to get into any dispute on this, but as an NDIS assessor, I can assure you that auditors can and do raise nonconformities against providers who do not maintain a record of employee secondary employment.

The NDIS Practice Standards and Quality Indicators do not discriminate category of employee

DIVISION 2      –              Governance and Operational Management

    OUTCOME       -              Human Resource Management

    (10) For each worker, the following details are recorded and kept up to date:

    (a) their contact details;

    (b) details of their secondary employment (if any).

Auditors will ask for evidence of employee records and will be looking to see if secondary employment is captured.

    Regards,

    Michael

    H everyone,

Again it is the terminology of how NDIS write things in my opinion.   They used the word  "should"  .   Why couldn't the NDIS write must instead of Should?

From a law site for reference:
